The court held that, in the absence of such disclosure and in line with statutory provisions and banking custom, the fixed deposit sum of Kshs 20,000,000 was to bear interest at the statutory court rate of 6% per annum from the date of the matriarch's death (6th February 2000) to the date of judgment (10th July 2007), and that such accrued interest would itself accrue further interest at 6% per annum from the date of judgment to the date of payment in full.
