Paez v Republic (Criminal Appeal E084 of 2026) [2026] KEHC 9311 (KLR) (29 June 2026) (Ruling) Neutral citation: [2026] KEHC 9311 (KLR) Republic of Kenya In the High Court at Kibera Criminal Appeal E084 of 2026 DR Kavedza, J June 29, 2026 Between Maria Artmelis Medina Paez Applicant and Republic Respondent Ruling 1.The applicant was charged and after a full trial convicted for the offence of trafficking in narcotic drugs contrary to section 4(a) of the Narcotic Drugs and Psychotropic Substances (Control) Act No. 4 of 1994. She was convicted to serve fifteen (15) years imprisonment. In addition, she was fined Kshs. 25,000,000 in default to serve 12 months imprisonment. 2.The applicant subsequently filed the present application seeking a review of his sentence. The application was admitted for hearing, and directions were issued fixing it for hearing on 29th June 2026. 3.When the matter came up on that date, the Court was informed that the applicant had since completed serving the sentence imposed by the trial court and had already been released from custody. Consequently, the application had been overtaken by events and no live issue remained for determination. 4.In the circumstances, there is no further order that this Court can properly make.
