The court held that, following recent Court of Appeal decisions declaring the mandatory life sentence for defilement unconstitutional, it had discretion to set aside the life sentence imposed under section 8(2) of the Sexual Offences Act and substitute it with a definite term of imprisonment. The court further held that section 333(2) of the Criminal Procedure Code requires that time spent in remand custody prior to conviction be taken into account when computing the sentence.
