Ratio Decidendi

The court held that it is the right of a litigant to withdraw a suit or application at any stage, as provided under Order 25 of the Civil Procedure Rules and affirmed in Isaac Salat v IEBC & 7 others (2014) eKLR. Upon withdrawal, the general rule is that costs follow the event, as stipulated in Section 27 of the Civil Procedure Act and the decision in Rai v Rai (2014) eKLR. Since the plaintiffs withdrew their suit and there was no objection from the defendants, the court allowed the withdrawal and awarded costs to the defendants/respondents. The substantive issues of adverse possession and extinguishment of the defendants' rights were not determined due to the withdrawal of the suit.
