Ratio Decidendi

The court found that the claimant's cause of action for unpaid commission under his employment contract arose either upon his retirement on 31.12.2011 or when the respondent unequivocally refused to pay the commission on 23.1.2012. Since the suit was filed on 7.11.2014, less than three years after the cause of action arose, it was not statute barred under section 90 of the Employment Act. The court further held that the objection to jurisdiction was solely based on the alleged time bar, and since the suit was not time barred, the court retained jurisdiction to hear the matter. The preliminary objection was therefore dismissed with costs to the claimant.
