Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Does the High Court have jurisdiction to revise a sentence imposed for rape following the Supreme Court's clarification in Muruatetu?
  2. 2 Can a convict seek both appeal and revision in respect of the same sentence?
  3. 3 Is revision available against a decision of the High Court or only against decisions of the magistrate's court?

Ratio Decidendi

The High Court lacks jurisdiction to revise a sentence for rape based on the Supreme Court's clarification that the Muruatetu decision applies only to mandatory sentences for murder. The applicant, having already appealed and had his appeal dismissed, cannot seek revision of the same sentence. Furthermore, revision is only available against decisions of the magistrate's court, not against decisions of the High Court. The application is therefore incompetent and must be dismissed.
