Procedural Posture

Constitutional Petition / Ruling on Post Judgment Applications (stay, Review, Execution)

  1. 1 Whether Itakey Investments Limited, as successor to the 10th Respondent, could validly seek stay and variation of the judgment after its joinder was dismissed by the Court of Appeal.
  2. 2 Whether the execution of the judgment should proceed before the County Government of Kilifi identifies and demarcates the access road as ordered in the judgment.
  3. 3 Whether the orders issued ex parte on 5th February 2018 should be set aside for want of locus standi and misrepresentation.

Court Disposition

Application by Itakey Investments Limited struck out; execution to proceed after identification of access road; costs of 6th February 2018 application to be borne by each party.
