Ratio Decidendi

The Plaintiffs failed to prove that the 3rd Defendant was in occupation or possession of the suit property, either directly or through tenants. The Surveyor's report did not list the 3rd Defendant or her tenants as occupants, and the Plaintiffs conceded they had not confirmed her occupation at the time of filing suit. The evidence showed that those in occupation claimed allocation by the Municipal Council of Embu, not tenancy under the 3rd Defendant. As such, the Plaintiffs did not establish a case for eviction or vacant possession against the 3rd Defendant. The suit was therefore dismissed as against her, and costs awarded to the 3rd Defendant as the successful litigant.
