Ratio Decidendi

The Court found that the applicant had satisfied both limbs required for the grant of a stay of execution under Rule 5(2)(b) of the Court of Appeal Rules. First, the applicant demonstrated the existence of an arguable appeal, regardless of its ultimate success. Second, the Court was persuaded that if the applicant were evicted from the suit property before the appeal is heard, such eviction could be irreversible or, if reversible, would entail significant costs and inconvenience, thereby rendering the appeal nugatory. The Court therefore allowed the application for stay of execution pending the determination of the intended appeal, with costs to abide the outcome of the appeal.
