The Court of Appeal lacks jurisdiction to hear a second appeal from the High Court in its appellate jurisdiction concerning the validity of the election of a Member of County Assembly. This is because Section 75(4) of the Elections Act provides for an appeal to the High Court on matters of law only from the Magistrate's Court, and Section 85A only allows a second appeal to the Court of Appeal in respect of membership of the National Assembly, Senate, or County Governor, not County Assembly members.
