The High Court found that while the appellants were lawfully convicted of malicious damage to property and sentenced to three years' imprisonment, the trial court erred in suspending the sentence because Section 15 of the Criminal Procedure Code only permits suspension of sentences not exceeding two years. The suspension order was therefore illegal. Additionally, the compensation order of Kshs. 2,000,000/- was set aside as the trial court failed to provide a clear evidentiary basis for the award, and such a claim is more appropriately determined in a civil suit to safeguard the appellants' right to defend against it.
