The court found that while the applicant is not entitled to a stay of execution under Order 22 rule 25 of the Civil Procedure Rules, as the parties in the declaratory suit and the primary suit are not the same, the applicant may seek a declaration that the insurer is liable to settle the judgment. However, this does not bar the decree holder from executing against the insured. The court exercised its inherent jurisdiction under section 3A of the Civil Procedure Act to grant a stay of proceedings in the primary suit for a limited period, conditional upon the applicant providing a bank guarantee for the decretal sum within 21 days.
