Ratio Decidendi

The court found that the Respondent terminated the Claimant's employment without justifiable cause and failed to follow the mandatory procedure under Sections 41 and 43 of the Employment Act. The Claimant's absence, even if unauthorised, did not absolve the Respondent from the obligation to notify him of the risk of replacement and to accord him a fair hearing. The absence of such notice and procedure rendered the termination both substantively and procedurally unfair. Consequently, the Claimant was entitled to compensation for unfair termination and salary in lieu of notice, but not for overtime or public holidays, as those claims were not proved.

Court Disposition

Judgment for the Claimant.

Orders

  • The Respondent shall pay the Claimant three months' salary in compensation (Kshs. 54,000).
  • The Respondent shall pay the Claimant one month's salary in lieu of notice (Kshs. 18,000).
