Ratio Decidendi

The court found that there exists a genuine dispute as to the 1st Garnishee's liability to satisfy the judgment debt, specifically regarding the sufficiency of funds in the Defendant's accounts at the time of service of the Garnishee Nisi order and the status of the accounts as collateral securing credit facilities. In accordance with Order 23 rule 5 of the Civil Procedure Rules, 2010, the court determined that these issues must be tried and determined before a final order (Garnishee Absolute) can be issued. The court therefore declined to make an absolute order at this stage and directed that the matter proceed to trial on the disputed issues. Costs were ordered to be in the cause.
