Ratio Decidendi

The court found that after the expiry of the probationary contracts, the Respondent failed to provide a written contract specifying the Claimant's terms of employment, contrary to statutory requirements. As a result, the court inferred that the Claimant was entitled to the salary set out in the 1 August 2010 contract from 1 March 2010. The Respondent underpaid the Claimant by Kshs 7,250/- per month for five months, totaling Kshs 36,250/-. The termination was procedurally unfair as the Respondent did not comply with section 41 of the Employment Act, failing to notify the Claimant or allow him to make representations before dismissal. The Claimant was therefore entitled to one month's pay...
