The Tribunal found that the landlord served a valid tenancy termination notice in the prescribed form on the tenant, both via WhatsApp and by process server, in compliance with Section 4 of Cap 301. The tenant failed to oppose the notice within the statutory period and only filed a reference out of time without seeking or obtaining leave as required by Section 6(1) of Cap 301. The Tribunal held that, in such circumstances, Section 10 of Cap 301 entitles the landlord to possession without further inquiry into the grounds for termination.
