Ratio Decidendi

The court found that the Claimant did not prove she continued working for the Respondent after the business closed on 30th April 2012, as there was no documentary evidence of work or demand for salary for the period claimed. However, the Respondent failed to formally retrench the Claimant in accordance with Section 40 of the Employment Act, 2012, rendering the termination procedurally unfair. The Claimant was therefore entitled to compensation for unfair retrenchment, payment in lieu of untaken leave, and admitted salary arrears for March and April 2012. Claims for further salary arrears and damages for auctioned goods were dismissed for lack of proof and nexus to the Respondent.

Court Disposition

Claim partly allowed against the 1st Respondent.
