The court gave the applicant the benefit of doubt regarding service and found that, in the interest of justice, the application to set aside the dismissal and reinstate the suit should be granted. However, this was made conditional upon the applicant taking a hearing date within thirty days from the date of the ruling. Costs were ordered to be in the cause.
