Procedural Posture

Notice of Motion / Ruling on Interlocutory Application for Temporary Injunction

  1. 1 Whether the Plaintiff/Applicant has established a prima facie case with a probability of success to warrant the grant of a temporary injunction.
  2. 2 Whether the Plaintiff/Applicant is entitled to an order restraining the Defendants/Respondents from interfering with the suit property pending determination of the suit.

Ratio Decidendi

The court found that the Plaintiff/Applicant failed to establish a prima facie case with a probability of success, as the documents produced (unsigned and undated conveyance and transfer forms) did not constitute proof of ownership of the suit property. The absence of contest by the Defendants/Respondents did not relieve the Plaintiff/Applicant of the burden to prove her case. Since the first condition for granting a temporary injunction was not met, the court was not required to consider the other conditions (irreparable injury and balance of convenience). Consequently, the application for a temporary injunction was dismissed.
