Ratio Decidendi

The court found that the Plaintiff entered into possession of the suit land in 1989 after paying the full purchase price and has since exercised exclusive, open, and uninterrupted possession, developing the land and treating it as her own. The Defendant and his predecessor took no steps to dispossess her or assert their rights for over 12 years. The Plaintiff's possession met all the legal requirements for adverse possession under the Limitations of Actions Act and relevant case law. The court concluded that the Plaintiff's right to the land had accrued by 2001, extinguishing the Defendant's title. The Plaintiff is therefore entitled to be registered as the proprietor of L.R NO....
