The court found that the application for eviction and enforcement of the decree was irregular and incompetent as it was filed and served against a deceased respondent. The Civil Procedure Rules require that where a sole defendant dies and the cause of action survives, the legal representative must be substituted before further proceedings can be taken. Service of process on a dead person is a nullity, and no valid proceedings can be maintained against a deceased party. Since no personal representative had been brought on record, the application could not be entertained and was fatally defective.
