Since mediation is not binding without consensus and no enforceable agreement was reached, referring the matter back to the same mediator would serve no useful purpose. The court therefore vacated the order referring the matter to mediation and directed that the parties comply with pre-trial procedures under Order 11 of the Civil Procedure Rules to facilitate a hearing on the merits.
