Ratio Decidendi

The court found that the Kiogoro Land Disputes Tribunal acted without jurisdiction in determining disputes relating to title to registered land parcels Nyaribari Chache/B/B/Boburia/9154, 9155 and 9156, as such jurisdiction was not conferred by Section 3(1) of the Land Disputes Tribunals Act No. 18 of 1990. Consequently, the Tribunal's awards were null and void ab initio. The subsequent adoption of these awards by the Magistrate's Court as judgments and the execution thereof, resulting in the cancellation of the Petitioner's titles and transfer to the 4th, 5th and 6th Respondents, were equally null and void.
