Procedural Posture

Civil Suit / Ruling on Interlocutory Applications (injunction, Status Quo, Security for Costs, Notice of Withdrawal)

  1. 1 Whether the Plaintiffs have met the threshold for grant of prohibitory or status quo orders regarding LR. No. KWALE/GALUKINONDO/759.
  2. 2 Whether the notice of withdrawal dated 1st April, 2019 filed by the Defendants has any legal effect.
  3. 3 Whether the Defendants are entitled to an order for security for costs against the Plaintiffs.

Ratio Decidendi

The court found that the Plaintiffs failed to demonstrate a prima facie case or any real threat of disposal of the suit property by the Defendants, and that the application for injunctive orders was res judicata, having been previously determined. However, the court held that a status quo order was appropriate to preserve the current ownership of LR. No. KWALE/GALUKINONDO/759, as it remained registered in the 2nd Plaintiff's name. Regarding the notice of withdrawal, the court determined that the firm of Isaac Onyango could not properly represent the 2nd Plaintiff after the plaint was amended and the 3rd Defendant was transposed as the 2nd Plaintiff, rendering the withdrawal notice void....

Court Disposition

Plaintiffs' application for injunctive orders denied; status quo order granted; Defendants' application for security for costs allowed in part; notice of withdrawal struck out; costs in the cause.
