Ratio Decidendi

The court found that the Kwanza Land Disputes Tribunal lacked jurisdiction to entertain the dispute as the subject land was registered under the Registered Land Act, Cap 300. The tribunal's powers were limited by Section 3(1) of the Land Disputes Tribunal Act, which did not extend to disputes over registered land. The adoption of the tribunal's award by the Magistrates Court was therefore void, as the proceedings were a nullity ab initio. The appeal was allowed, the award and all consequential orders were set aside, and costs were awarded to the appellant.
