Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant's employment was unfair.
  2. 2 Whether the Claimant was accorded a fair hearing before termination.
  3. 3 Whether the Respondent had valid and fair reasons for termination.

Ratio Decidendi

Although the Claimant admitted to taking remnants of milk without permission, which constitutes a valid reason for termination under the Employment Act, the Respondent failed to controvert her assertion that this was a common practice previously tolerated. The Court found that while the process met statutory standards for procedural fairness, the sanction of summary dismissal was disproportionate to the circumstances. The punishment was deemed too severe, and a warning would have been more appropriate. Therefore, the termination was substantively unfair, entitling the Claimant to compensation and other terminal dues.

Court Disposition

Claim allowed in part; termination found unfair; compensation and terminal dues awarded.
