Under Kenyan law, only a person who has been granted letters of administration and is thus a legal representative of the deceased's estate may be substituted as a party in a civil suit. The definition of legal representative in the Civil Procedure Act and the Law of Succession Act does not include intermeddlers or persons acting as administrator de son tort. While Indian law recognizes intermeddlers as legal representatives for substitution, Kenyan law does not.
