The court found that the third party directions issued on 12th October, 2004 were obtained without service on the 1st 3rd party, in violation of the requirements of the Civil Procedure Rules. Since leave to issue the third party notice had been granted ex parte, the law required that the affected party be served and given an opportunity to challenge the proceedings at the next stage. The failure to serve the 1st 3rd party was both an irregularity and a defect of process, depriving the 1st 3rd party of the right to be heard and to challenge the third party notice.
