Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the defendant has satisfied the conditions for grant of stay of execution pending appeal.
  2. 2 Whether substantial loss would result to the defendant if stay is not granted.
  3. 3 What security, if any, should be imposed as a condition for stay of execution.

Ratio Decidendi

The court found that the defendant demonstrated a likelihood of suffering substantial loss if stay was not granted, given the large decretal sum exceeding Kshs. 7,000,000/-. The court reasoned that if the amount was paid to the plaintiff and the defendant succeeded on appeal, recovery might be difficult. The court accepted the defendant's willingness to abide by conditions and found the plaintiff's proposal for security reasonable. Accordingly, the court granted a stay of execution on condition that the defendant deposits Kshs. 7,000,000/- in an interest-earning joint account within 30 days, failing which the stay would lapse automatically.

Court Disposition

Application for stay of execution allowed with conditions.

Orders

  • Execution of the judgment and decree is stayed for 12 months from the date of ruling or until determination of the intended appeal, whichever comes earlier.
  • Defendant to deposit Kshs. 7,000,000/- in an interest-earning joint account in the names of advocates for both parties within 30 days; failure to do so discharges the stay automatically.
