Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant, Mary Wachana, has the requisite locus standi to file the application and appeal.
  2. 2 Whether a stay of execution of the Deputy Registrar's ruling in Kitale HCCC No. 131 of 2000 should be granted pending appeal.
  3. 3 Whether the appeal would be rendered nugatory if the stay is not granted.

Ratio Decidendi

The court found that Mary Wachana, the applicant, lacked the requisite locus standi to file the application and the appeal. Her only involvement in the original suit was as an objector, whose objection was dismissed and whose subsequent appeal was withdrawn. The eviction order was directed at Wafula Sitialoi, not Mary Wachana. Therefore, only Wafula Sitialoi had standing to challenge the Deputy Registrar's orders. The application by Mary Wachana was thus held to be misplaced and incompetent, leading to its dismissal.

Court Disposition

Application dismissed for lack of locus standi.

Orders
