The court found that the Respondent fulfilled the procedural fairness requirements under Section 41 of the Employment Act by issuing a show cause letter and inviting the Claimant to a disciplinary hearing. The Claimant failed to respond to the show cause memo and did not attend the disciplinary hearing. The court held that the Claimant was not at liberty to ignore the employer's summons and could not claim she was denied an opportunity to be heard. Consequently, the claim for unlawful and unfair dismissal failed. However, the Respondent admitted owing one month’s salary in lieu of notice, and did not produce leave records to counter the claim for 20 days’ leave pay, which was therefore...
