The High Court held that the Kiambaa Land Disputes Tribunal lacked jurisdiction to order the subdivision of land where the original parcel had already been subdivided and ceased to exist. The Tribunal's decision entailed the subdivision of already subdivided land and involved issues of title and beneficial interest, which are outside the scope of the Tribunal's powers under section 3(1) of the Land Disputes Tribunal Act. The Tribunal therefore acted beyond its jurisdiction, rendering its decision a nullity.
