The court found that the Land Disputes Tribunal Githunguri acted outside its statutory jurisdiction by purporting to determine ownership of registered land and ordering revocation and subdivision of title documents. Section 3(1) of the Land Disputes Tribunal Act limited the tribunal’s jurisdiction to matters of boundaries, occupation, or trespass, not ownership or title. The subsequent adoption of the tribunal’s award by the Principal Magistrate’s Court and the issuance of a decree were therefore nullities in law.
