The Tribunal found that the landlord had, by letter dated 1st May 2020, reduced the rent to Kshs. 15,000 per month due to the pandemic, and the tenant relied on this representation. The landlord's subsequent attempt to revoke the reduction and revert to the original rent without proper notice contravened the requirements of Section 4 of Cap 301, which mandates a prescribed notice period for altering tenancy terms to the tenant's detriment. The Tribunal held that the doctrine of estoppel applied, preventing the landlord from arbitrarily reverting to the higher rent.
