The court held that Section 94 of the Civil Procedure Act vests discretion in the court to allow execution of a decree before taxation of costs, provided the decree was issued in the court's original civil jurisdiction. The Plaintiffs had obtained a final judgment and decree for possession of the suit property, and the 2nd Defendant had not obtained any stay of execution from either the trial court or the Court of Appeal. The mere filing of an appeal or application for stay does not operate as a stay of execution, and the court retains jurisdiction to enforce its decree. The court further found that the eviction procedures under Sections 152A-152G of the Land Act do not apply to evictions...
