Ratio Decidendi

The court found that the period of 2½ months between the date of judgment and the filing of the application for leave to appeal out of time was not inordinate. The applicant demonstrated due diligence in obtaining the judgment and filing the application. The court was satisfied that good cause had been shown for the extension of time, and the respondent failed to demonstrate any prejudice that would result from granting the application. Accordingly, the court exercised its discretion under Section 349 of the Criminal Procedure Code to allow the application and grant the applicant an additional 30 days to file the appeal.
