  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal under Order 41 rule 4 of the Civil Procedure Rules.
  2. 2 Whether substantial loss may result to the applicant if stay is not granted.
  3. 3 Whether the application was made without unreasonable delay.

Ratio Decidendi

The court found that the applicant had satisfied the requirements for grant of stay of execution pending appeal as set out in Order 41 rule 4(2) of the Civil Procedure Rules. The court was satisfied that substantial loss may result to the applicant if stay is not granted, and that the application was made without unreasonable delay. The court also imposed conditions for security by ordering the decretal amount to be deposited in a joint interest-bearing account. The respondent's objections regarding the merits of the appeal and the attachment already effected were not considered relevant to the determination of the application for stay.

Court Disposition

Application for stay of execution granted with conditions.

Orders

  • The entire decretal amount is to be paid within 2 weeks into an interest bearing account in a bank approved by both sides in the joint names of the advocates representing the two parties.
  • The applicant to pay forthwith the respondent’s costs incurred in connection with the execution proceedings.
