Ratio Decidendi

The court held that although Rule 63 of the Probate and Administration Rules does not expressly recognize Order 22 of the Civil Procedure Rules, this omission is not fatal to the objection proceedings. The Law of Succession Act and its rules do not provide for execution or objection proceedings, but both parties had relied on Order 22 in their applications. The court exercised its inherent power under Rule 73 to allow such proceedings. On the merits, the objector proved ownership of the attached motor vehicle, and there was no evidence to the contrary. The attachment was therefore wrongful, and the objection was allowed.
