Ratio Decidendi

The Court found that the trial magistrate's Court lacked pecuniary jurisdiction to hear and determine the suit, as the value of the subject matter (Kshs 3.5 million) far exceeded the statutory limit of Kshs 125,000 applicable at the time. Jurisdiction is fundamental and cannot be conferred by consent or overlooked; any proceedings conducted without jurisdiction are a nullity. Consequently, the lower Court's decision and all subsequent proceedings were void ab initio, and the appeal could not be determined on its merits. The only proper course was to strike out the appeal and set aside all consequential orders.
