Ratio Decidendi

The Tribunal found that the landlord complied with the statutory requirement to give notice of the intended rent increase, as the notice was served in the prescribed form and allowed more than two months before taking effect. However, the Tribunal held that it would not be fair to determine the new rent solely on the landlord's valuation report. The tenant must be given an opportunity to file their own valuation report, after which the Tribunal will make a final determination on whether the proposed increase is justified. In the interim, the Tribunal ordered the tenant to pay rent at a rate between the old and proposed amounts, pending further evidence from both parties.
