The High Court found that the 1st respondent was properly recognized as a wife and beneficiary of the deceased, based on the Chief's letter and corroborated testimony from the deceased's siblings, which was not sufficiently rebutted by the appellants. On the issue of the property, the court determined that the sale agreement established the 1st appellant as a joint purchaser with the deceased, creating a joint tenancy. By operation of the principle of survivorship, the property automatically vested in the 1st appellant upon the deceased's death and was thus excluded from the estate available for distribution under the Law of Succession Act.
