Ratio Decidendi

The court found that the respondent received the party and party costs from the Independent Electoral and Boundaries Commission on behalf of the applicant. However, since the respondent had a taxed advocate/client bill of costs showing that the applicant owed him money, and the applicant had not challenged this taxation, the respondent was entitled to exercise a lien over the funds received. The law recognizes the advocate's right to retain client funds until their costs are paid. The applicant was not entitled to the full amount of the party and party costs without first settling the advocate's costs. The application for payment of the full sum was therefore without merit and was dismissed.
