The court held that while a verifying affidavit is a mandatory requirement under Order 53 Rule 1(2)(b) of the Civil Procedure Rules, the supporting affidavit filed by the applicants set out the facts relied upon and served the same purpose as a verifying affidavit. The omission to file a verifying affidavit was therefore a procedural defect curable under Article 159 of the Constitution, which mandates courts to administer justice without undue regard to technicalities.
