Once the appellate court has determined the sentence, the matter is finalized at that level, and the High Court, being lower in the judicial hierarchy, cannot revisit or further review the sentence. The applicant's reliance on Sections 216 and 329 of the Criminal Procedure Code is misplaced, as these provisions do not empower the High Court to review a sentence after appellate determination. The application is therefore without merit and constitutes an abuse of the court process.
