Ratio Decidendi

The High Court lacked original jurisdiction to revoke a grant issued by a magistrate's court after the coming into force of the Magistrates' Courts Act, 2015, which amended section 48(1) of the Law of Succession Act. The proceedings initiated in the High Court for revocation of the grant made in Bungoma CMCSC No 273 of 2017 were incompetent ab initio, as such jurisdiction was exclusively vested in the magistrate's court. Consequently, all orders, including the consent order of March 12, 2020, and subsequent grants issued by the High Court, were null and void. The application to set aside the consent was merited, and the entire miscellaneous cause was struck out for want of jurisdiction...
