The Tribunal found that, in the absence of a mutually agreed fresh lease, the terms of the expired leases govern the parties' relationship. The Landlord was not entitled to unilaterally impose new rent terms or to levy distress for rent based on disputed arrears calculated under those new terms. The Tribunal held that the Landlord should have sought determination of the disputed arrears before instructing the Auctioneer to levy distress. The Tenant is liable to pay any outstanding arrears as calculated under the expired leases, and the Landlord must serve a fresh notice of termination. Both parties are to reconcile their rent accounts, and the Tenant is to pay the arrears in six equal...
