The Kadhi’s Court retains jurisdiction over dissolution of marriages celebrated under Islamic law, even if one party has reverted to another faith, provided the marriage was registered as Islamic. However, the right to a fair trial is fundamental and requires proper service of process, including notice of hearing and access to virtual proceedings. In this case, the applicant was not properly served with the hearing notice or the court’s virtual link, and did not consent to or sign the application for registration of divorce.
