The High Court lacks jurisdiction to enhance the sentence imposed on the respondent because the respondent was not served and therefore was not given an opportunity to be heard, as required by Section 364(2) of the Criminal Procedure Code. The proviso to Section 364(2), which allows for revision without hearing the accused where the trial court fails to impose the minimum sentence, does not apply in this case because the sentence imposed, though lenient, was lawful under Section 26(3) of the Penal Code.
