Ratio Decidendi

The court held that it would be improper to proceed with contempt proceedings against the respondent's Deputy Commissioner-HR while an application for stay of execution is pending before the Court of Appeal. Although there is no formal stay of execution in place, the court and parties are required to defer to the appellate process to avoid conflicting outcomes and to respect the hierarchy of courts. The application for contempt is therefore stayed pending the outcome of the Court of Appeal's determination on the stay application. The claimant is at liberty to renew her application for contempt after the appellate process is concluded.
