There was no independent evidence, such as a surveyor's or land registrar's report, to establish trespass. The Applicant's allegations were contested and could only be resolved through a full hearing in a civil suit where evidence could be tested. Consequently, the Applicant was not entitled to an eviction order or consequential enforcement orders at this stage. The court also considered the familial relationship between the parties and exercised its discretion to order each party to bear their own costs.
